Supreme Court Revives Abortion-Pill Restriction

Your right to have an abortion was established in 1973 when the Supreme Court declared abortion legal across the US in its landmark decision, Roe vs. Wade. In 2000, the FDA approved mifepristone, a medication used to end early pregnancies, but it restricted it, making doctors provide it in a medical setting rather than allow people to get it in pharmacies.  Under COVID, to keep people safe from unnecessary exposure to infection, some doctors started to mail the pills directly to patients.  They interpreted the FDA requirements to mean only that they had to package the medications in their office, not that they had to also hand them to the patient there.  Some activists who felt that the FDA rules prohibited mailing pills and wanted clarification brought a case to the courts.  In July 2020, Judge Theodore D. Chuang ruled that under the pandemic emergency, the FDA could not require that patients pick up the pills in a doctor’s office, clearing the way to mail them.  However, the Trump Administration appealed the case to the Supreme Court which recently reversed that decision, stating that the courts do not have the authority to tell the FDA what to do. 

There is a lot of debate as to whether or not the FDA rules prohibit mailing these pills directly to patients, and some providers have continued to ship while others have not.  Each and every member of the MYA Network operates independently and decides within their own practices what they are able to do, but we all share the common values that we are committed providing safe and accessible abortions to all who ask for them, and that we will fight for your right to obtain one.
